it is hereby requested to all users to go through the terms and conditions enlisted below carefully and also to understand them before agreeing to become user of this application. These terms and conditions provides for general instructions to users as to matters governing between application and users. By mere accessing of the application you shall be deemed to have accepted the terms and conditions. Once accepted plea of ignorance is not to be raised by any person. Acceptance forms and implied agreement which binds the person and is estopped from later denying the same or claiming no knowledge or understanding of them.

we “New You SPA and Beauty” have caused to develop this application for the purpose of providing the service of massage, spa and cosmetic at the fingertips of users. Users can avail the service through this application select from the available services and book an appointment. User can avail the services while at home without having to visit anywhere. This application provides services at the convenience of the user at their selected time and place.

Words appearing here after shall be construed according to their natural or dictionary meaning however Interpretation of some terms used is to be done as follows:

• We or us or our: shall to be construed to mean “New You Spa & beauty”.
• User: means any person who uses this application and becomes user by following the process of registration by this application.
• Services: shall mean the description available to potential users under this application. It includes various kinds as given in the application like massage, spa and cosmetic facility.
• Masseur or beautician or therapist: means the person who is to perform the services of spa, massage of different kinds as provided in the application, or any other person expert in cosmetic service.
• Appointed date: means the date on which service is to be provided to user for which user has booked appointment with the application.
• Point, Offer, discount: means additional benefits given under this application for users who selects a particular package and the same can be redeemed in subsequent service. Similarly discount means any deduction in total cost of services provided to users by us. Offers means any package offered with more benefits or less charges from time to time in this application.
• Application or App: to mean the application of” New You SPA and Beauty” on Android, iOS and Website which provides various beauty and spa services to its users.
• “You” “your”: shall mean user using this application. However the terms “you” “your” shall mean any person whether being a user whether avails any service or not.

Process:

• Process: user is to observe the following process for the purpose of availing services provided by us through this application.
  • User has to download the application from relevant store.
  • Register themselves with the application.
  • For the purpose of registration user is to follow the process as provided in the application.
  • Entering mobile number and entering OTP which will be sent to users via sms.
  • Entering email address or alternatively user can also log in via Facebook account.
  • User has to capture location for the purpose of adding their location.
  • User can avail any service by selecting from various services as provided under the application.
  • Upon selection of service further sub categories or various packages for that particular service are provided like regular, premium and diamond.
  • User can go for book appointment by selecting date and time.
  • User has to give pick up location.
  • User can select from various offers provided by us.
  • System of points and discount is also given in the application which can be redeemed by users at later appointment.
  • User can view booking details and points earned.
  • Masseur or beautician will reach the user at given address on appointed date and time performs services requested by users.
  • After services user shall pay for the services availed as per rates mentioned therein.
• Only mentioned services: we provide only those services which are mentioned in the application and no service other than what is mentioned in the application. Users shall not demand or request performance of any other services.
• Users/ masseur/beautician/therapist : users who can avail services under this application shall only be females of any age for the purpose of removal of any ambiguity it is hereby clearly state that these services are not to be provided for male users. Likewise all the masseur/ beautician or any other cosmetic expert who is to provide service shall also be female. If any person creates profile under this application who being male and disguises as female shall be liable to prosecuted from our end for fraud.
• Conveyance: the masseur or beauticians or therapist shall perform the massage, spa and cosmetic service at the desired place of user and shall reach the place through cab. The fare of such cab is added to the charges of services.
• Communication: Users has to communicate in the course of dealing with us with only through the application.
• Description of services: a detailed description of each service selected by user is provided in the application as to duration, material to be used in service, benefits of the service. Actual performance may slightly vary owing to various reasons.
• Payment: user is required to make payment for the availing the services under this application as per the rate specified therein in cash and in case of surprise some in by depositing the amount in our bank account. (Refer payment and refund policy).
• Rate: Rate is to include aggregate of services selected together with cab face and coupon discount if any is to be deducted from that amount. User can also redeem points previously earned and has to pay the net amount after these adjustment and the same shall be shown in the application
• Duration: means the time within which we shall make best endeavor to cause our masseur/therapist/beautician to reach the point of users and to perform the service within the time as specified in the description of package.
• Delay: delay means the time exceeding the time of performance of service than what is given by users to reach the point. For delay on our part discount is given and for delay from users to avail services additional charges are collected at the rates as given in the terms of payment.
• Territory: we provide services only in areas designated i. e. city of Dammam. We don’t provide the service beyond the areas specified unless we extend our territory.
• Cancellation: users can cancel the appointment once made or postpone it to a different date subject to availability however frequent cancellation shall entitle us to block the user.
• Dispute: Users by booking appointment with us is entering into transaction with us via electronic mode and the same is binding. If in case of any dispute as to rate, service, timings users can bring the issue to our knowledge and try to settle the same amicably by contacting us via phone or email.
• Information: User impliedly agrees that all the information regarding address, name etc. shall be correct and accurate.
• Confidentiality: Information or data entered by customers in the application or otherwise known through this application by us shall not be in any case shared with any third party to the prejudice of the customers, except when it is required by law or justified by law to do so or where there has been fraud played on by customers.
• Liability in case of usage of application: due care has been taken to ensure that all the information contained in this application is correct; despite all efforts in case of any error we shall not be liable. We don’t give any warranty regarding virus or any other similar programs that may occur due to usage of this application.
• Liability: we shall make our best endeavor to provide services selected by users through our best experienced and well trained therapist, beautician, and masseur. However it is the duty of users to inform about medical conditions like allergy etc. failure on the part of users to do so exempt us totally from any liability due to any condition suffered by users.
• Technical error: This being a net based mobile application may sometime mal function or cause some technical problem, we shall try to remove such defects at our earliest convenience, and shall not be liable to pay damages in case of such defect in running of the application.
• Marks, intellectual property: No person shall use our marks and shall be held liable for passing off incase similar or identical marks are used resembling our app or of same features or display design etc. and shall be liable for action as per the intellectual property laws as are applicable in the kingdom of Saudi Arabia including Copyright Law (Royal Decree No. M/41 of 2 Dated 2003) and unfair competition law, 2012.
• Other terms and conditions: besides the terms and conditions contained herein orders shall be subjected to terms and conditions issued by authorities in kingdom of Saudi Arabia like the Electronic Transaction law, unfair completion law, anti-cybercrime law, Telecom act rules, notification, by laws, notices and other general laws of commercial nature in force in the kingdom of Saudi Arabia as amended from time to time.
• Waiver: user cannot waive either by any act or abstinence any of these terms and conditions and privacy policy.
• Status: our masseur, therapist, beautician are the persons selected on the basis of their expertise and training in their field they are our employees and we shall instruct them to observe with great caution and care while dealing with clients and particularly while performing massage, spa etc. and in return it is expected from clients to treat them with dignity and respect. However if they act beyond the scope of their authority we shall not be liable for their action.
• Complaints: Any complaints or grievances shall be communicated through mail id provided or phone number given, best endeavor will be made to redress the same as soon as possible.
• Applicable laws: the Electronic Transaction law, unfair completion law, anti- cybercrime law, Telecom act rules, notification, by laws, notices and other general laws of commercial nature in force in the kingdom of Saudi Arabia as amended from time to time.
• Jurisdiction: any dispute arising as a result of usage of this application and ordering of goods shall be subjected to jurisdiction of courts in the city of Dammam only.
• Disclaimer: we can change the terms and conditions listed above without any prior notice and we reserve the right to amend them.
